Generally speaking, the statute of limitations to bring a claim under the National Vaccine Injury Compensation Program is three (3) years from the first day of symptoms or two (2) years from the date of death. However, when the vaccine injury table is revised to include an injury, the time to file a claim for that injury extends for a limited two-year period provided that the vaccine-related injury occurred within eight years of the revision to the vaccine injury table. The statute of limitations has been extended and you may be entitled to compensation if you file a claim by March 21, 2019.
On March 21, 2017, the Vaccine Injury Table was amended to include Shoulder Injury Related to Vaccine Administration (SIRVA) and Guillain-Barré Syndrome (GBS) as Table Injuries. What does this mean for you? It means that the time in which to file a claim for either injury has been extended. The time to file a SIRVA claim resulting from a vaccine which occurred on or after March 21, 2009 has been extended to March 21, 2019. The time to file a GBS claim resulting from a seasonal flu shot which occurred on or after March 21, 2009 has also been extended to March 21, 2019.
